Lokpal chocked in rajaya sabha!

Government's Lokpal which was passed in Lok Shabha  on Tuesday( DEC 27) was further discussed in Rajaya Sabha on 30 DEC  for complete passage by parliament. But this Lokpal  was opposed by several parties, even by allies of government.
Those who opposed wanted amendments, about  187 amendments were presented.
Thus government which was already without seats or number in Rajaya sabha also lost the numbers by its own allies on lokpal matter.

Main objections were:-
  1. Disturbing federalism and voilating constution by imposing  Lokayukta bill made by center on states. Parties like BJP,  CPM  and  Trinamool  were against this and saying that   Lokayukta bill prepared by states will go in vein if  center's  Lokayukta bill is imposed on them. These parties were thus demanding to delete Chapter 3 from lokpal which was imposing Lokayukta bill on states 
  2. Independence of cbi from political control- This independence was demended by BJP , Trinamool  ,CPM and BSP
  3. Lokpal's control over CBI- it was mainly demande by BJP
  4. Constructional Status-  Mainly Bjp stood against the constructional status of lokpal
To fulfill above demands 187 amendments were presented, but government said that this amount of    amendments could not be discussed and amended in one day.
Moreover government knew that if voting was done for lokpal in rajaya Sabha then Government because of lack of seats will loose voting. Hence voting was cancelled.

So now Lokpal may come only in next season of parliment i.e in  Budget  season in march 2012.
However since lokpal reached Rajaya Sabha so it will not be deleted and will remain in register till next season.

Anna ends his fast and cancelled Jail Bharo

Anna Hazare ended his three days fast strike in Mumbai on the second day of the fast.
His aides say the 74-year-old is not well enough to fast any longer; they also say he has been let down by the weak anti-corruption Lokpal Bill that was passed in the Lok Sabha last night. He will neither head to Delhi now, as discussed earlier, nor launch a civil unrest or jail bharo agitation, for which nearly two lakh people have signed up online.  Anna is now resting at a guesthouse in Mumbai, and is expected to head tomorrow to his hometown of Ralegan Siddhi in Maharashtra.

At a press conference this afternoon, reporters asked Anna and his aides pointed questions, some of them about why his camp at the MMRDA Grounds in Mumbai has drawn crowds that are tiny compared to the huge turnout for his Delhi protest camp in August.  Anna said he would soon move to Delhi for a sit-in at Ram Lila Maidan. Minutes later, his closest aide, Arvind Kejriwal, contradicted that. For now, he said, the agitation is suspended.

What Anna and Mr Kejriwal did stress is that the activists will now focus on campaigning against the Congress in the five states that vote between January and March. "The Congress has cheated us more than any other party, including the BJP," said Anna. "Whatever we are seeing today in Parliament is tragic. So I have decided to call off the fast today. There is only one way now. We will make a programme in the five states and go and awaken people there. I will tell them don't vote for traitors," he said.

The bill was passed in Lok Shabha yesterday ( dec 27) The bill will be debated in the Rajya Sabha tomorrow (dec 29)
 However lokpal's passage in RAJAYA SABHA is foggy, as government doesn't have majority in Rajaya Sabha and many parties are against government's  weak lokpal (see its weakness )

Last night, doctors said Anna was seriously unwell. His blood pressure was rising, and he was feverish. This morning, they warned that if he persists with his fast, he faces the risk of a kidney failure.

Anna responded today, urging his supporters not to let insults or criticism affect their morale.  "After all, people only throw stones at a tree that's bearing fruit, not a barren one," he said.

There were 5000 people at his camp today, an improvement upon yesterday's numbers. Team Anna had organized shuttle buses to move people from nearby stations to the camp. Privately, they say the MMRDA Ground is not an ideal location in terms of public transportation and connectivity. When asked about the lethargic response to his camp, Anna said, "People all over the country are supporting us. That is not a small thing."

Lokpal bill passed in Lok Sabha

Lok Sabha on Tuesday passed the Lokpal and Lokayukta Bill, 2011 by voice vote even as the Left, BSP and SP staged a walkout. SP and BSP staged a walk out from the Lok Sabha shortly before the voting on the lokpal bill in protest against the government bringing a "weak legislation"  
  • Lokpal bill was passed without Constitutional status due to lack of 2/3 consensus in parliament . 
  • Before the Lokpal Bill as put to vote the Government amended Section 24, the provision to keep armed forces under its ambit, 
  • the state government will decide on the Lokayuktas, 
  • and the requirement of three-fourth members of Lokpal to approve inquiry against the Prime Minister was changed to two-third.
  • The Leader of the Opposition raised objections to several issues including creation of Lokayukta through the lokpal bill and the process of appointment and removal of the ombudsman 
  • They also demanded inclusion of CBI under its ambit,


  • The lokpal bill was rejected as weak and inadequate by several parties which wanted it to be withdrawn even Manmohan Singh pushed for it while rejecting demands for bringing CBI under the ambit of the anti-graft ombudsman.
  • BJP's leader Yashwant Sinha called the Congress-led UPA government "morally bankrupt" which has brought a "brokepal" bill instead of lokpal bill. Sinha said that the rampant corruption in the country in the past years had prompted Anna Hazare to go on fast.
  • Earlier, Leader of the Opposition in Lok Sabha Sushma Swaraj said it should be sent back to the Parliamentary Standing Committee for further discussion to make it "effective and strong". "Accept our amendments or withdraw the bill... Send it back to standing committee for further discussion," she said while describing it as a "patently unconstitutional" legislation which the Opposition will not "tolerate".  
  • Tearing into the bill in its present form, Swaraj said it would "sow the seeds of second partition" as it has the provision for religion-based reservation which was "patently unconstitutional".
  • UPA partners, Trinamool Congress and DMK, also supporting parties like RJD and SP, maintained that the provisions to create Lokayuktas through a central legislation would impinge on the powers of the states and wanted that it should not be rushed under pressure of the Anna Hazare movement.
  • RJD chief Lalu Prasad also demanded its withdrawal contending that the bill was brought in "haste under pressure".


  • Pushing for passage of the bill, the Prime Minister said a "holistic" approach was needed to deal with the "cancer" of corruption but rejected demands for bringing CBI under the purview of lokpal, warning that no entity should be created inconsistent with the country's Constitutional framework.
     "I believe that the CBI should function independently of the lokpal. We believe that the CBI should function without interference through any Government diktat."He said
  •  Prime Minister also dismissed opposition to the provision on setting up of Lokayuktas in states, saying federalism cannot be an impediment in the war against corruption as essential services in the states are the "bane" of corrupt practices. 
  • Singh reiterated the supremacy of the Parliament and said that it should take the final decision on the bill. Singh said that others can persuade and have their voices heard but the final decision while making policy must rest with us.


  • Demanding that lokpal should be accountable to both Parliament and Supreme Court, CPI(M) leader Basudeb Acharia said corruption by corporates and business houses should be brought under the lokpal ambit. 


  • Kapil Sibal  led the Congress counter-charge and  hit out   at the BJP saying it had "political motives" to delay the bill so that it benefits them in the upcoming polls through Anna Hazare's campaign. "If you oppose this bill, you will be violating the sense of the House and people will never forgive you," he told the Opposition. 
Editor's View: This lokpal bill passed has a number of errors(see those errors ). Another thing to be considered is that Government got full time (more than 3 months to standing committee and full 6 months to government ) to frame a healthy lokpal so they or others should not blame Team Anna for lack of time.Government simply made a revengeful formality!! We didn't demand for this beggar faced lokpal!

Anna's agitation begins..

Anna Hazera began his three day fast today (27 december) on MMRDA ground in Mumbai

Anna Has shifted from Delhi to Mumbai due to harsh winter effect in Delhi

However it got a cold response in comparison to August's and April's fast. The estimate of people at the venue varied between 4,000 to 10,000 in sharp contrast to upto 30,000-40,000 that poured in Ramlila Maidan in August.
Team Anna had said that they expected over a lakh people to turn up at the protest venue here.
In Delhi too, a negligible number of protesters were at Ramlila Maidan.

 from December 30 Jail Bharo (Jail accumulation protest) will begin which will end on January 1.  
Addressing the protesters, Hazare vowed to continue the "fight to the finish", warning the UPA government that he will campaign against it in the upcoming Assembly elections in five states and later in the Lok Sabha polls.

Seeking to broadbase his agitation, Hazare said he has invited Baba Ramdev to join his stir and the yoga guru will visit the fast venue tomorrow or the day after.
Accusing the government at the Centre of betraying the people, he said, "this is not betrayal of Anna Hazare or Team Anna. This is the betrayal of people who will teach you a lesson."
Editor's View: it would be to early to say that its a flop trial by Team Anna , but its also true that public is having lack of faith in team because of recent attacks on Team Anna ( because of those blames which are till now not proved to be true!!)

"Anna Hazare worked as Secretary with RSS leader Nanaji Deshmukh and trained in 1983 in Gonda. See Nai Duniya front page today," Singh today wrote on his twitter page. 
 
However, Team Anna did not hesitate in giving a tit-for tat-response.
 Kiran Bedi also posted a picture of Digvijaya Singh sharing a dais with Nanaji Deshmukh, questioning his RSS links.
"Does sharing of the dais make one each other's agent. Next time shud one sit alone? When two persons share a dais do they become each others agents,?" Kiran asked. 


Meanwhile, Union Minister Beni Prasad Verma also joined the tirade calling Anna an Army deserter, but his claims seemed to bite dust with the report from Army in which army cleared that Anna's record in army is clear and full of might.
Army records made it clear that  Hazera
 was honourably discharged in 1975 after completing his 12 years of service.Hazera has also won medals for his service.

Agitation planning

Anna's agitation and fast against government's Lokpal (see its weakness here) is going to begin from December 27 ,2011 on MMRDA ground in Mumbai( Anna Has shifted from Delhi to Mumbai due to harsh winter effect in Delhi)

On 27 Anna's fast will start and from  from December 30 Jail Bharo (Jail accumulation protest) will begin which will end on January 1. 
Arvind Kejriwal and Kiran Bedi will also join in the fast, which would simultaneously be held in Delhi. 

"MMRDA will give some concessions and the ground hire cost will be 
Rs. 7 lakh. The donations will be accepted only by cheque and draft. We will also keep tab on the donors," Hazera saidBombay High Court  has  rejected the petition for direction to Maharashtra government for allotting MMRDA ground for free or at concessional rates for his fast.

Flaws of government's lokpal


  • Government's Lokpal does't covers more than 90% of political arena(Political Black Money is the common corruption prevailing in country)
  • It doesn't covers any political party (which are mostly found using money and arms to win elections)
  • Big companies are out of lokpal's ambit ( 2g scam shows how corruption prevails in business also, if companies aren't covered by lokpal how such corruption will be controlled)
  • Only five per cent of employees are in its ambit. 
  • Mojor elements which are vulnerable to corruption are out of lokpal, so what's in?
    NGO's like Temples, mosques, schools, colleges, hospitals, dispensaries, cricket clubs, gurudwaras, self help groups etc are under it( its humorous, tell me how many of us feel red alert amount of corruption in these places, the areas where lokpal's ambit is necessary are omotted and the places which are not run by government or where there is no corruption that a common man faces are forcefully inserted in lokpal, its funny but also funny enough to cry!)
  • MORE TO FEAR
  1. As per Government Lokpal, Lokpal will be appointed by Prime Minister, Lok Sabha Speaker, Leader of Opposition in Lok Sabha, Chief Justice of India and a government-nominated jurist. ( look at the high political volume present in the selection committee of lokpal, it means lokpal will be appointed by politics and hence obviously will work for government!)
  2. In Government's bill CBI is not under lokpal (but worse is that cbi is under government control! )
  3. Lokpal just performs initial investigation and further is done by CBI( whose independence from government is not laid!)
  4. Through government's bill, the CBI will be even made ineffective as its right of initial inquiry will be snatched. 
  5. There will be pseudo- superintendence of lokpal over CBI i.e  superintendence is just an attractive word written on bill because lokpal cannot ask CBI the 'do or don't' as CBI under Government will already be with the instructions given by politicians.
I want to made a request to all my countryman  that if you support Anna then continue your support but I f you don't Support him then at least don't support this impractical bill made by government . Do your own protest if you don't want to do protest with Team Anna!

Team Anna, Dictator to parliament?


Lalu Ji Today (December 22 meeting) said that eliminate Lokpal bill and asked why A team of activist is dictating parliament? 
Well its surprising that Lalu who made a scam of Rs 950 crore is saying this. 

And after wasting 
950 crore of country is still in parliament to present his views.There are many MP's and incidents which erased our faith towards parliment. Cash for vote for exampleAfter all this Image of parliment and government is not made by Team Anna , its a self made image!  
I demand government to perform an election with all new parties and to re-setup parliament with those new parties
then I guarantee that no one will ask question on or 'dictate' parliament's procedure. 




Lokpal in parliament

Lokpal bill with constructional status was introduced  Lok Sabha today.  The Bill will be actually debated on December 27 after which it will be put to a vote. 
Different sides including  BJP, Team, and Lalu Prasad Yadav have all  rejected it for different reasons.
Looking at small time period  to debate in parliament, different MP's have said that the Bill must not be rushed through to satisfy the deadline or demands of Anna.

--THIS VERSION OF LOKPAL FACED FOLLOWING OBJECTIONS IN PARLIMENT TODAY (
Dec 22)--
  • Team Anna taunting the government said that government's old Lokpal was better that this new one Or government had worsen the lokpal in the time given to them.
  • Hazere objects to the fact that the Lokpal Bill does not hand over administrative control of the CBI to the new ombudsman or Lokpal. Without this, his group says, the CBI will continue to be influenced in its investigations by the government.
  • Lalu also opposed for his own regions
     Last night, the government had removed the term 'minorities' where the Bill asks for a 50 per cent quota for the Lokpal. That's because the Constitution does not allow for reservation on the grounds of religion. But after Lalu led a raucous protest over this in the morning, the Lok Sabha was adjourned for a few hours. So Government decided  he minority quota would be reinstated through a correction in the language of the Bill
  •  Senior leader Sushma Swaraj said, "The Supreme Court has repeatedly ruled that reservation cannot cross 50 per cent. This Bill sets apart a quota for 'not less than 50 per cent.' There are nine members - so it suggests reservation for five members. So if we go with this Bill, it will be struck down in seconds as patently unconstitutional. This language is not acceptable. Take back the Bill."
    Mr Mukherjee agreed that the quota is likely to be challenged in court, but said the government wants the judiciary to settle the matter. 
  • Ms Swaraj also said that the Bill violates the federal principles of the constitution by enforcing states to adopt it and create Lokayuktas or anti-corruption agencies. "This infringes upon the rights and dignity of states," she said.
  • Lalu also made a lengthy speech. He said
     "Why are we letting a team of four people who include a retired bureaucrat, two retired lawyers, and a social activist dictate terms to Parliament? The country should be run by authority, not agitation"
  •  Lalu objected to the inclusion of the Prime Minister among the offices that the Lokpal can investigate. "Hundreds of people will file politically-motivated cases, he said. What face will we show abroad if our leader travels there and he is being investigated at home?" He urged the government to ignore Anna's fast. "Let him look after his own health," he said. "Take back this Bill, send it to a standing committee, fix it and then convince us to pass it," he said.
  • Gurudas Das Gupta of the Left was also unflinching in his criticism of Anna, describing him as "a man who pretends to be another father of the nation." He said, "There is no single crusader against corruption. Please don't be afraid of another hunger strike."
  • Though this is the argument that the government has so often made, Mr Mukherjee had to defend the need to handle the Bill with urgency. He stressed that legislation can only be done in the House, not in agitations or on the street. But he also made the point that in August, both Houses of Parliament had appealed to Anna to end a 12-day fast by promising to consider his vision of the Lokpal Bill.
Editor's View: Well bill of  course lacks power, and it is clear from the reports and discussions, but more surprising element is that some MP's are lacking brain and maturity! Lalu Ji made a scam of Rs 950 crore and still is in parliament to present his views.

what lokpal is without cbi?

According to recent steps by government it seems that Lokpal will behave just like a complaint filing institute. 
  •  Lokpal will conduct preliminary(or initial)  investigation into a corruption complaint and refer it to CBI for investigation.
  • CBI would investigate the same and then forward the case to the directorate of public prosecution to be created under the supervision of Lokpal. 
  • Any suggestion by the Lokpal for prosecution should be accepted. A rejection, if any, should come either from the secretary of the department(lokpal) concerned or a higher authority.
  • The committee outlined a structure that harmonises or coordinates the roles of the Central Bureau of Investigation, Central Vigilance Commission and Lokpal.
MAIN ARTICLE  
Problem is not that lokpal will undertake 
initial  investigation but is that further investigation will be done by a institute which is promptly misused by any party in majority. If government does not want cbi under lokpal then its OK, but its is never good having government's control over cbi. So government should as a alternate solution to the situation at least take some steps to eradicate its own  control over cbi. Because if Cbi will be free from any political control then we also don't need it under lokpal.
However if opposite happens
and government doesn't its own  control over cbi.  (which is actually happening) then all that will happen is that we will have same cbi(under political control) and a Lokpal without enough power for investigation, so I ask governmet how will the investigation be transparent and non-prejudiced ?and in that way how is this lokpal powerful.

UPDATE {21/12(1p)}

The winter session of Parliament, which was scheduled to end on December 22, has been extended by three days from December 27 to discuss Lokpal Bill and other legislations. 

Anna has threatened to go on hunger strike from December 27 if Parliament fails to pass a strong Lokpal Bill, but there is no unanimity among the different parties on the proposed Bill.
the UPA has decided to withdraw the old draft and introduce a new one in Parliament even though several smaller parties have accused the Government of trying to rush though the proposed anti-corruption legislation. 

Even as UPA Chairperson Sonia Gandhi addressed Congress MPs and assured them that the government bend further to please Team Anna and the Opposition, the UPA withdrew the old bill and decided to introduce a new draft. The BJP has given its nod to this proposal.

She told her party colleagues that the Government won't go down without a fight on the Lokpal Bill and will ensure that it doesn't meet the same fate as the Women's Reservation Bill.
She also reiterated that the Government and the party were united on the issue and hit out at the Opposition in general and the BJP in particular for trying to derail the Lokpal Bill.
"The Lokpal Bill has been cleared by the Cabinet. The Opposition will have lots of things to say. They should accept suggestions of Government. Team Anna should also accept it. The Opposition cannot reconcile to the fact that they lost (the 2009 Lok Sabha elections). The party and Government support each other, there is no rift between the party and Government," said Sonia.

Rashtriya Janata Dal (RJD) chief Lalu Prasad, Samajwadi Party Chief Mulayam Singh Yadav and Communist Party of India (Marxist) leader Sitaram Yechury have questioned the UPA Government's intention while making it clear that Parliament will not rush through the anti-corruption legislation in a hurry to please Hazare and his associates.
Mayawati-led Bhaujan Samaj Party is also against rushing through the Bill while the Shiv Sena has opposed the concept of a Lokpal completely. The BJP and Biju Janata Dal have also opposed the Government version, but want an early passage of the Bill.

The BJP is yet to reveal its strategy but it has said that the party is ready for a discussion on the Bill any day. It is likely to raise objections on the procedure of the appointment of the Lokpal panel.
However, Keeping up the heat, Team Anna on Wednesday attacked the government for keeping CBI out of Lokpal's ambit, saying it 'totally destroys' the anti-corruption mechanism in the country by not giving an investigating arm to the ombudsman.
Team Anna member Arvind Kejriwal said the new bill will do "more harm than doing good" to the existing anti-graft machinery. Bedi said onTwitter, "The bill is not path breaking but breaking the path. Thank you Sonia G."

Cabinet approves Lokpal Bill (but disapproved many of Anna's demand)

The Lokpal Bill draft has been cleared by the Union Cabinet on Tuesday. The government has decided that the CBI will not be under the Lokpal .The cabinet met in the parliament house complex under the chairmanship of Prime Minister Manmohan Singh

  • The government has decided that the CBI will not be under the Lokpal's control  and also decided not to hive off the Directorate of Prosecution from the investigative agency.

  1. The Lokpal, with Constitutional status, will, however, have superintendence over the cases referred to CBI
  2. Lokpal will also have the powers to carry out preliminary inquiry to be headed by a Director of Inquiry and will have a prosecution wing under a Director.  The Inquiry Wing will be headed by a Director for preliminary inquiry. The Lokpal can also ask the CBI to conduct the preliminary inquiry, which should be completed within 180 days.  Ideally, the preliminary inquiry should be completed within 90 days and extension if necessary should be sought in writing. 
  3. Sources also say that the Prime Minister, Leader of Opposition, CJI will choose the CBI chief. The Lokpal will have no say in the matter.
  4. Appointment of SPs and above in CBI will be done by a committee consiting of CVC, Vigilance Commissioners, Home Secretary and Secretary, DoPT. 
  5. Lokpal cannot initiate any inquiry suo motu and a complaint will be required. 

  • Prime Minister will be under the purview of the Lokpal with certain safeguards that will keep out aspects like international relations, public order, atomic energy, space, internal and external security from the inquiry.  Probe on any complaint against the Prime Minister will be decided by the full bench, of which at least three-fourth should agree. 
  • According to sources, the government has proposed in the draft that the the Lokpal selection committee will comprise of the Prime Minister, Lok Sabha Speaker, Leader of Opposition in Lok Sabha, Chief Justice of India and a government-nominated jurist.But Anna is against more political volume in the selection committee
  • According to the proposal, Lokpal will be an eight-member body and former CJI or SC judge or an eminent person will be Lokpal Chairman.  
  • The government has now proposed 50% reservation for SC/ST, OBCs, Minorities and Women in the Lokpal bench and in the search committee. 

Sources said that the bill will be tabled in the Parliament as early as on December 22.
    Anti-corruption crusader Anna Hazare was quick to hit back. He rejected the Citizens' Charter bill and his team had demanded this should be part of the Lokpal Bill.
    Anna on Tuesday rejected government's Lokpal draft and Citizen's Charters' Bill, saying he will go on fast, hold a 'Jail Bharo Andolan' and campaign against the government in the five election-bound states.
    Expressing disappointment with the new draft Lokpal Bill to be tabled in Parliament, Anna said he would fast for three days from December 27, followed by a three-day 'jail bharo' agitation.
    "I will fast on December 27, 28 and 29. This will be followed by a three-day jail bharo from December 30. After this, I will go to five states (where Assembly polls are due) and campaign against the (Congress-led) government," Anna said.

    Editor's View: Well government is not arming lokpal with much powers, and without these powers lokpal will be merely a report filing institute. 
    My question is why government is showing so resistance in giving lokpal powers and is making selection committee of lokpal full of political dominance?

    Cabinet meeting on Lokpal delayed again!

    On saturday(Dec 17 ) PM said that cabinet will discuss lokpal on sunday(Dec 18) but it didn't happened, and hope was that bill will be conserdiered in cabinet today(monday) but again it postponed to tomorrow's cabinet meet. According to reports, the meeting is likely to take place at around 2 p.m. tomorrow.
    Ahead of a cabinet meeting tomorrow, senior ministers have studied the Lokpal Bill and made major changes. Law Minister Salman Khurshid described the attempt as "a cleaning up of the draft."  But sources say Mr Khurshid, P Chidambaram and Kapil Sibal, all noted lawyers, have over-ruled earlier suggestions to
    • place a portion of the CBI under the Lokpal, and 
    • a reservation quota for its nine members. 
    Their suggestions will be studied by the cabinet  at meeting tomorrow.

    Parliamentary Affairs Minister Pawan Bansal said the revised Lokpal Bill is expected to be tabled in Parliament on Wednesday or Thursday; the Parliament session could be extended by three days, starting December 27, he said.
    Earlier Kiran Bedi has made it clear that if government extends winter season of parliament that Anna may wait. But Team Anna's main demend is to pass the bill in the current season( winter season).

    The final deliberations over the Lokpal Bill are focused on the relationship between the CBI and the Lokpal or the nine-member ombudsman that the bill creates. The Lokpal's mandate will be to handle complaints of corruption filed by the public against government servants. Who will investigate these complaints, and how, is what has political parties divided. There is agreement that the CBI must have complete investigative autonomy. But whether it should report to the Lokpal - either in part or whole - has confounded politicians.

    Sources say the Prime Minister, the Leader of Opposition, and Lok Sabha speaker will form a panel that will appoint the CBI chief. The Lokpal Chairman will not be part of CBI chief's appointment. The group of ministers have decided not to carve out the prosecution section of the CBI and assign it to the Lokpal.


    The extent of the Lokpal's jurisdiction has been a brittle and persistent theme of conflict between Team Anna and the government. Anna said the Prime Minister could not be exempt from the ombudsman's review. He also said that unless lakhs of junior bureaucrats are held accountable, the malignant grasp of corruption on everyday life will not be defeated. After deliberations with other parties, the government plans to suggest a few safeguards that would protect the PM from frivolous complaints, and from the disclosure of details of national security. Group C and D employees - the junior bureaucrats - will be investigated by the existing Central Vigilance Commission or CVC, which will provide the Lokpal with regular updates on its inquiries.

    Lokpal Bill expected to be considered by Cabinet tomorrow(monday dec 19)

    The Union Cabinet is expected to consider tomorrow (monday dec 19) the much-awaited Lokpal Bill.


     With the Union Cabinet set to discuss the Lokpal Bill tomorrow, sources have told NDTV(news org) that Prime Minister Manmohan Singh will hold a high-level meet to give final touches to the Cabinet note on the bill. The high-level meet will be held to resolve all outstanding issues on the Lokpal Bill, the sources added.

    The crucial Cabinet meeting precedes Prime Minister Manmohan Singh's assurance to all parties concerned with the government's commitment to pass the contentious bill in the current session of Parliament that ends on December 22. "No one should doubt our sincerity in passing the bill in this season," the Prime Minister said yesterday.

    With the government under constant pressure by anti-corruption activist Anna Hazare for a strong Lokpal, the UPA government's top ministers -Telecom Minister Kapil Sibal, Law Minister Salman Khurshid and Minister of State in the PMO V Narayansamy - met this evening to finalise the note on the proposed legislation to be circulated among the Cabinet meeting.


    NDTV(major source) has exclusive information about the contours of the Lokpal Bill that will be brought to the Cabinet. Some of its key features are:

    • The Prime Minister will be under Lokpal but with certain safeguards
    • The PM can be referred for a preliminary probe if three-fourth of all Lokpal members agree
    • The proceedings will be in camera, and the report will have to be sent to the Parliament
    • On the issue of the Central Bureau of Investigation (CBI), the agency will report to the Lokpal only on cases referred to it by the ombudsman
    • The CBI chief's appointment remains an outstanding issue and will be dealt with later, though in principle, the government agrees on a selection panel comprising the Prime Minister, the leader of the Opposition, the Lok Sabha speaker and the Lokpal chairman
    • On the issue of the removal of the Lokpal, the government doesn't favour an impeachment
    • The removal of the Lokpal can be done through a reference of the President
    • If 100 MPs sign a petition against any Lokpal member, the President has to refer the complaint to the Supreme Court
