Govt rejects panel's suggestions of lokpal

HAPPENED ON DEC 18.
Department of personnel and training (DoPT) under the prime minister turned down the select committee's recommendation that an official facing an inquiry from the Lokpal not be given an opportunity to be heard at the stage of preliminary enquiry (i.e  before a case is lodged) .For this purpose  government changed Clause 20(3) of the version of Lokpal bill (suggested by Rajya Rabha selected parliamentary panel )

The DoPT also rejected the suggestion that officers on a particular probe not be transferred without Lokpal's consent when the investigation was on. The government rejected this proposal, and brought in an amendment saying transferring any official would remain the exclusive right of the government. The government insisted that the Lokpal must seek the comments of the public servant against whom it may be conducting an enquiry . 
For this purpose  government also changed Clause 20(2) of the bill 

|this resistance offered by govt wil further delay the passage of lokpal which is stuck in Rajya Sabha for almost a year( and whose implementation has been demanded by citizens about 2 years ago)|

The government has mostly agreed to other recommendations of the select committee which has delinked the creation of Lokayuktas in states and exempting the PM from the ambit of Lokpal on matters of security, atomic energy and international relations.

Ramdev's fast update


Complete update till date
  • Ramdev who on Aug 9 started his three days fast, on the third day of the fast (11 Aug) gave an ultimatum to Govt to respond to key demands till 5pm of the extended fourth day of fast ( i.e 12 Aug)
  • As government ignored the ultimatum, Ramdev today (Aug 12) on 4th day of his fast at Jantar Mantar hit out at the Congress-led UPA government saying it has no political will to rein in corruption and bring back black money stashed in tax havens. 
  • He said that he will take his agitation countrywide and asked the countrymen to join his movement.He also clarified his non political motive behind the movement.
  • However, during the campaign he had given invitation to all parties and members of Parliament to join his fast.
  • Today  Former Indian Army Chief V.K.Singh and Kiran Bedi were seen sharing stage with Ramdev.However  Anna Hazare and other members of the team have stayed away.  
  • During his fast Baba also tried to promote his secular image by carrying out  iftaar each evening as the Ramzan month is going on. 
  • Ramdev is likely to announce his "big announcement” on the next course of his agitation on Monday.
  • A large amount of crowd is attending the Baba's fast.

Team Anna began their indefinite fast at Delhi's Jantar Mantar today(julf 25 ,2012)  to highlight the corruption within the government and to push for the anti-graft Lokpal Bill. Arvind Khejrival, Manish Sisodia, , Gopal Rai ,Akhil Gogoi sat on fast from today. However Anna Hazare despite the medical warnings  will begin fasting from Sunday(29).

 
The backdrop of the stage has photographs of the Prime Minister and 14 other ministers against whom T.Anna presented proofs of corruption and want a SIT(Special Investigation TEAM) instead of CBI to dig in their cases.The photo of Pranab Mukerji whose name is also included in list of 15 ministers for Ghana Rice Export Scam and who is now president of nation was however covered with a cloth by Team Anna.
Kejriwal alleged that the Congress has "put a chadar (veil)" to protect the former finance minister. 
In a Press Conference at Delhi yesterday, Team Anna clarified their stands  and said that their protest is limited to three demands which are as follows
  1. A SIT probe against 15 Ministers(click here to know more)
  2.  Team Anna also demanded that cases of  162 Lok Sabha members and 39 Rajya Sabha members(of whichever party) who are also facing corruption charges  should be given to the fast track courts
  3. SIT to go into allegations against party chiefs.
  • Team Anna will also use the fast  to share evidence collected against the ministers it has accused of graft. 
"According to the  Constitution, the President has immunity against any investigation. We have given evidence against Mukherjee to Prime Minister Manmohan Singh and Congress chief Sonia Gandhi two months ago," Khejrival said.

Government's Reply
 Law Minister Salman Khurshid suggested the activists should "write to the United Nations."  He said, "They want an  independent probe into matters which have been rejected and disapproved by the Supreme Court."

Fight at the venue 
There was a fight at the venue in the morning, when a group of 15-20 people shouted slogans against Kejriwal. According to Team Anna they were members of the Congress' youth wing, the NSUI. The party has denied this. 

Turnout Fast has got an good reaction but the turnout today was small compared to the sort of crowds Anna gathered last August, when he held a 16-day long hunger strike in Delhi to demand new legislation to tackle corruption.

New panel on Lokpal called Law secretary for advice

Background
Lokpal bill was earlier referred to a new parliamentary panel consisting of 15-member Committee chaired by Congress leader Satyavrat Chaturvedi by Rajya Sabha on May 21 2012


NEWS

  1. This panel held its first meeting on Monday(25 June)  and has decided to call Law Secretary BA Agarwal to seek clarity on legal aspects involving the Lokpal Bill
    The Law Secretary is expected to brief the panel on the legal aspects of the Bill at its next meeting on July 4.
  2. Panel also decided to seek opinion from a broad spectrum of people on the issue.
  3. It was also decided to issue a public notification inviting comments on the Bill and call representatives of various ministries for recording of evidence.
It is interesting to note that several members of panel could not make it to the meeting for various reason ranging from delay in flight to lack of information about the meeting.


Editor's View: A parliamentary panel was also  formed about six months ago on the issue of  Lokpal. Lot of discussion with experts from different fields occurred  After that it was send to cabinet and then it arrived in Parliment at the end of winter season and got chocked in Rajya Sabha . Again, as bill arrived in Rajya Sabha, it was again referred to another panel. Clearly, same cycle of PCP (Panel-Cabinet-Parliament) has begun. This cycle may be required once but purpose of repeating the cycle is  nothing but to delay the Lokpal's implementation and deteriorate its quality!

Centre should move more aggressively on Lokpal: Youth Congress

OVERVIEW  Finally, youth congress has accepted that corruption affects common man and hence it is needed to be tackled by forming lokpal structure in our penal system . 
Youth Congress led by  Rahul Gandhi has underlined the need to tackle the menace "on a priority basis" and wanted Centre to move "more aggressively" on setting up of Lokpal.
The political resolution passed at the three day national executive meet of Youth Congress at Hubli in Karnataka contains following points and demands
  •  asked for the setting up of special courts to try only corruption-specific cases.
  • Noting that corruption affects the common man most, the resolution said,"it needs to be tackled on a priority basis".

  • The resolution recommended "more stringent penal provisions" to punish the corrupt public servants by amending the Prevention of Corruption Act.
  • The youth body of Congress has also demanded that the "code of criminal proceedure (CrPC) should be amended in order to ensure speedy disposal of corruption-related cases.
    The political resolution also demanded that "the Central government should move more aggressively on Constitutionally guaranteed Lokpal bill".

BACKGROUND: Rahul Gandhi had last year made a strong pitch in the Lok Sabha for constitutional status to Lokpal.

Team Anna to fast from July 25

As soon as lokpal bill was once again referred to a parliamentary committee by Rajya Sabha, Team Anna accused government of betraying the people once again and delaying Lokpal Bill’s passage as well as announced another indefinite fast at Jantar Mantar from July 25.
However, Anna Hazare due to his poor health won't fast 
but will guide the team and only Team Anna members will fast this time. Anna will only  Kejriwal, Manish Sisodia, Gopal Rai and Akhil Gogoi  {Gogoi is already on hunger strike since May 19, in support of the anti-dam protests}  will sit on indefinite fast.
The decision about members of Team Anna sitting on indefinite fast has been taken because Anna is not in great shape after several fasts in last one year. So, it was decided that this time team would sit on fast. At present, it is confirmed that at least four members would sit on fast. The number can increase.It doesn’t mean Anna would not be there. Anna would be there but he would only sit for the agitation. He would guide the team all along,” the source added.

The team would also be demanding a special independent investigation against 14 cabinet ministers of the Congress-led UPA-II, in the absence of an independent agency like Lokpal

Lokpal Bill tabled in Rajya Sabha, no consensus yet

  1. The Lokpal bill was taken up for discussion in the Rajya  Today(  May 21 2012) two days before the budget session ends. 
  2. Bill was referred to a parliamentary panel or Rajya Sabha panel for consideration as parties have failed to come to a consensus on the Bill's provisions.
  3. Last night, the government had circulated a notice of amendment to the Bill, especially on the Lokayukta provision, leading to speculation that the measure could be brought for consideration and passage.(see side effects of this amendment 
Soon after the Bill was tabled, the Samajwadi Party moved a motion for referring it to the select committee. The BJP, however, objected to it.So The government later moved motion to refer the Bill to the select panel. Those who refereed bill to parliamentary pane commented that Bill should be referred because of lack of consensus over major issues like lokpal's dominance over the CBI etc.
Editor's View: We want to ask two things
  1. Why the Bill is always discussed in the last days of a particular session? Last time  in winter season of parliament bill was discussed just three or two days before season's deadline. Similarly now too in budged season the bill is tabled just two days before it ends!
  2. Why there is never a consensus over some issues which makes lokpal bill powerful?
    consensus will occur both Government, its allies and opposition will not hurdle the procedure. Hence, lack of consensus reveals that political class weather Govt or opposition don't want to pass this bill! 
The Bill was already sent to parliamentary panel and now again the same drama is being played, this will do nothing but delay the passage of bill to infinity! (also see Politicians are fooling Public over lokpal matter)

Parliamentary Update: Lokpal Bill likely to come up in Rajya Sabha by 21 or 22 May

Lokpal Bill is likely to be taken up by Rajya Sabha either on Monday(21 may) or Tuesday (22 May) .
But Bill would be debated and discussed in its 
in amended form which includes deletion of the controversial provision for Lokayukta(state level Lokpal) creation and bringing more transparency in appointment of CBI chief. |Its bad to delete Lokayukta provision, because than states will be free to make an unregulated Lokayukta and such unregulated Lokayuktas which will be uneven and unequal in different states will weak down the overall structure of Lokpal. Moreover, there is no guarantee that states will always create a strong lokpal, e.g himachal prades Govt and Bihar Govt have created very weak Lokayuktas  and hence we would have to fight for a strong Lokpal in every state seperately!|(also see Toothles condituon of Present Lokayuktas created by states


  • The government and the opposition have agreed the Lokayukta clause should be dropped from the Bill and a separate model law can be passed which can serve as a guideline for the state to form their own anti-graft law.
  • The amended bill was widely speculated to be considered by the Cabinet today(may 17) but it did not happen with the sources saying it could be given post-facto approval after passage in the Rajya Sabha. 
  • As far as bringing NGOs within the ambit of Lokpal is concerned, the government may agree to the opposition's suggestion that only government-funded NGOs be under the ombudsman's purview. 
  • Once the Bill is passed by the Rajya Sabha with amendments, it will have to be sent back to the Lok Sabha for re-examination and approval because this is a different version than the one cleared earlier.

  • Heeding demands from opposition parties and allies like Trinamool, The GOVT may drop the clause on setting up a Lokayukta in the states  A minister, however, said that discussions are still on with the political parties concerned to thrash out the differences. 
  • Sources in the government say that a major change will be made to the bill to accommodate the objections of Mamata Banerjee, who is a member of the ruling coalition, but had opposed the proposed  legislation claiming that it violates the autonomy of state governments.  

  •   Once the Bill is passed by the Rajya Sabha with amendments, it will have to be sent back to the Lok Sabha for re-examination and approval  because this is a different version than the one cleared earlier.

Anna started his Maharashtra's Tour

Anna Hazare started his Maharashtra Tour for a strong Lokayukta Bill( state level Lokpal ) on Tuesday evening from Shirdi in north Maharashtra.

After seeking the blessings of Sai Baba and addressing a public rally at Shirdi in the evening,
Hazare  hit the road, along with his group of supporters. Anna had specially chosen the Maharashtra day to embark upon his Statewide tour 
During his 36-day tour which will take him to 35 districts of the State, Hazare will address 60 public rallies.
Tour is aimed at creating awareness among the people about the need for a strong Lokayukta legislation in the State. 
Hazare began his tour of the State, less than a week after he met leaders of various political parties in the State — excepting Shiv Sena chief Bal Thackeray who refused to meet him, and submitted them the copies of the draft Lokayukta Bill prepared by Team Anna. 

Hazare’s tour should be seen in the light of the fact that Maharashtra Chief Minister Prithviraj Chavan
has not given him any commitment as to when his Government would introduce the Bill. 
“I feel that the office of Lokayukta will not be included in the Lokpal Bill. I had written to Centre to enact a model law of Lokayukta so that all States can adopt their own act as per the model law. The Centre is favourable to the model law proposal ..However if the model law also does not come out, we will begin the process of enacting a strong Lokayukta here,” the Prithviraj Chavan had said.


Schedule:-
  • During the first phase of his tour, Hazare will cover the districts of Marathwada, from where he will head to Vidarbha region. Subsequently, he will travel through the districts of north Maharashtra, from where he will proceed to western Maharashtra and Konkan.
  • Hazare  would undertake a tour of Maharashtra from May 1 to mobilise public opinion on the issue of having a strong "Lokayukta" in every state.  
  • After Maharashtra tour he will start his countrywide tour by the end of June.
  • Ramdev will also perform a countrywide tour, however this will not be joint to Anna's tour.
  • Ramdev and Anna may share stage whenever needed or  when they meet during their tours

What Kalam Said is directly proportional to What Anna wanted (short analysis )



Both the people Kalam and Hazare are correct in their views, Kalam's view that Lokpal can't clean the corruption in the minds and heart of people until people they " make their homes corruption-free by preventing indulgence in corruption by any member of the family"
And Anna's Lokpal is also needed because people will not stop taking or giving bribes until there is some legal support to public and legal hammer for corrupt officer! 
Both statements are correct and actually directly proportional to each other but the need to understand them correctly..

Lokpal will only fill the jails: APJ Kalam

 Former president APJ Abdul Kalam Today( May 2, 2012)  while interacting with children in Ranchi said that lokpal will only do the work of filling culprits into jails.
And he doubted this manner of crumbling corruption saying that  "What we want is nobody should go to jail ... as we want good human beings," .  He advised the children there to make their homes corruption-free by preventing indulgence in corruption by any member of the family. 

"What Lokpal will do is if it finds anyone guilty it would put them in jail, and jails will be filled up. What we want is nobody should go to jail ... as we want good human beings,"
Dr Kalam said. 
While iteracting

REPLIES to Dr Kalam :- 
  1. Anna Hazare responded to Dr. Kalam saying  "I agree that corruption can be weeded out if value education is imparted to children, but it will take at least 22 years. In short term, we need Jan Lokpal to boot out corruption," Hazare said.
  2. He also said  "What he (Kalam) said is correct. I have also been saying that every family must become a unit of moral values. It will take over 22 years to see the effect of the virtues children have learnt from their families. However, that is a long-term solution, in short term, we need a first-aid to stop corruption,"
  3. On twitter, Ms Bedi responded to Dr Kalam's comments. She wrote: "Dr Kalam takes socio-moral route to root out corruption. Effective system is a fusion of educating-prevention+effective legal deterrence!"

Anna met Baba Ramdev for future steps and andolan: Is it a right step?

Anna Hazare and Baba Ramdev met on Friday (April 20, 2012) and addressed the media about their future co bonded plans .They asked government leave aside ego and pass a strong lokpal.
Demand to bring back black money in Swiss accounts was also raised by Anna-Ramdev bond.


Anna said that
every government and party is same and equally corrupt.



FUTURE PLANS


  1. Anna Hazare and  Baba Ramdev will jointly sit on a day's token fast in Delhi on June 3 for Lokpal demand and awareness.  A joint rally will also take place on same day
  2.  Ramdev said that he will start a massive agitation against black money from May 01.  “I will tour Chhattisgarh in May and awaken people on the issue of black money,” said Ramdev.
  3. Hazare  would undertake a tour of Maharashtra from May 1 to mobilise public opinion on the issue of having a strong "Lokayukta" in every state. 
  4. Both will continue to campaign and tour the country till 2014 General Elections and will make people aware so that they raise their voice against corruption
Quote: Their worlds:- 

  • Anna made it clear that in his view every political party is equally corrupt.  "Making the government fall is not our intention. If this government is graduate in corruption, the next government will do PhD. But a government that can't understand people's voice, it's not a (matter of) concern if it falls," Hazare said.

  • While Ramdev gave a statement contradicting to Anna's view of "every party is equal" saying that   "present government had no right to rule."
Editor's View: | WRONG STEP TAKEN !|
According to Janlokpal Bill Center this step taken by team Anna is not appropriate. Simple reason is that those who don't support Ramdev or oppose him even support Anna or in simple worlds more people support Anna than Ramdev. So those who oppose Ramdev but support Anna may not support Anna-Ramdev bond.
Moreover ideologies of Anna and Ramdev are not truly equal, Anna said that every party is equally corrupt, on the other hand Ramdev blamed congress saying that it has no right to rule. Religious row may also occur, so Team Anna should dilute this decision of working with Baba Ramdev.

Differences remain on Lokpal Bill; no consensus on creation of Lokayuktas

In All party meeting on March 23 the difference on the Lokayukta matter remained stagnant. Opposition is saying that a forced Lokayukta on sates would destroy federal structure and right of state governments.Parties like  BJP,  CPM  and Trinamool  are saying that Lokayukta bill prepared by states will go in vein if  center's  Lokayukta bill is imposed on them. .{ Lokayukta in simple words is state-level Lokpal/corruption watchdog}

So 
Lokpal Bill is likely to be amended to remove the portion on creation of Lokayuktas in states. All-party meeting saw the entire Opposition and a section of UPA - Trinamool Congress, DMK, NCP and the National Conference - opposing the Lokayukta provision in the bill.  The meeting was attended by leaders of 20 parties, all of whom are members of the Rajya Sabha, besides the prime minister and finance minister Pranab Mukherjee

With the first half of the budget session of Parliament drawing to a close on March 30,
there will be very little time to take up a discussion on the bill in the Upper House, especially as there are still major differences on contentious clauses. It is expected that a resumption of the debate will, therefore, be taken up only during the post-recess period. 
Editor's View: All the parties are now showing their true colors, weather BJP or congress. Both opposition and majority are putting hurdles on the implementation of the bill. Opposition like bjp demanded and supported a center Lokpal but when it came to sate level lokpal(i.e lokayukta) then they are showing bad faces, bjp is doing this because is more prominent in states and hence its corrupt deeds may come before people after passage of a state level lokpal.
All the politician class is same, when they have to pass a increase in their salary then there is a consensus but when they have to pass an anti-corruption bill then there is two sided and foggy attitude.SHAME ON US that we elected such non-sense

Govt pledges to debate Lokpal Bill in House before March 30

With Opposition in the Rajya Sabha insisting on an immediate resumption of a debate on the Lokpal and Lokayukta Bill, the government on Wednesday said that it would bring it for further discussion during the first part of the Budget Session of Parliament (by March 30). However, it said that the discussion would be initiated only after other businesses like the Motion of Thanks to the President's address and passing of both General and Rail Budgets.
On Wednesday, Bansal, however, said the Lokpal and the Lokayukta Bills topped the agenda during the first half of the Budget session that ends on March 30. He said that the Motion of Thanks to the President's Address would be taken up first, followed by passing of General and Rail Budget and then the Lokpal Bill would be discussed. 
Replying to a notice given by Leader of the Opposition Arun Jaitley seeking suspension of the Question Hour to resume debate on the Bill, parliamentary affairs minister P K Bansal said the government has studied the 187 amendments moved by both Opposition and allies in UPA-II since debate on the Bill was adjourned after the House was adjourned sine die on December 27. 
Bansal disagreed with Jaitley, who had cited Rule 257 to state that discussion on Lokpal Bill has to be taken up since it remained inconclusive when the House was adjourned sine die. "There are other bills which we deferred...which were not concluded," Bansal said.

Jaitley quoted Rule 257 to state that the chairman if he deems necessary can adjourn the proceedings of the House for a timeframe to be decided by him. "The debate cannot be indefinitely abandoned."

Federal Structure issue shadowed toothless condition of Lokayuktas

ANALYSIS While many of the  parties like  BJP,  CPM  and Trinamool  are opposing  Chapter 3 from lokpal which is imposing Center's Lokayukta bill on states saying that Lokayukta bill prepared by states will go in vein if  center's  Lokayukta bill is imposed on them. .{ Lokayukta in simple words is state-level Lokpal/corruption watchdog}

But this opposition has almost shadowed following poor facts about State Lokayuktas Bills


  1. Out of 28 states only 19 have Lokayukta instituted.
  2. Of 19 merely 3 lokayukta are OK(not even good)
  3.  Most of the state lokayukta bills can't investigate Governer, Chef Minister and legislatures.
  4. Some lokayuktas like of Andhara Pradesh have been restricted to look into Government's procedural lapses and  delays
  5. Recommendations made by institution are not accepted actively.
  6. In some states even Lokayuktas (investigators) are not appointed
Some pitiful Examples of state lokayuktas

  • In W.Bengal the lokayukta only have two group D people as staff!
  • In Karnataka, no one is holding the post
  •  Gujrat was not appointed with Lokayukta for eight years from 2003 until in 2011 Kamla Beniwal appointed issed an ouder
  • In Rajasthan, lokayukta don't have investigation agency of its own

Only Uttrakhand have reasonable Lokyukta.

After all this opposition (who form government in states) are trying to defend such flawed and weak sate made lokayukta bills.

Its true that Feudal system should be respected but using it to defend flaws and corruption is quite different.This shows state government doesn't want to take pains to renew their flawed lokayukta bills or to set up new lokayuktas

This decision of making lokayukta a state defined creation is wrong as it will make Lokayukta different in every state as well as will make it vulnerable to become a state based weak bill leading to difficult usage of bill in multi-state corruption cases|
