During Anna's Anshan MPs blamed that Anna is blackmailing parliament. Now after Anshan Media is debating on it. So of course citizens are confuse that weather they gave wrong support to Anna or were they right to support a bill which is intended to be Constitution changer ?
Now lets clarify some facts and make situation a little bit clear.
- ANSHAN CONTROVERSY- The Lokpal bill was first introduced by Shanti Bhushan in 1968 and passed the 4th Lok Sabha in 1969. But before it could be passed by Rajya Sabha, Lok Sabha was dissolved and the bill lapsed. The Subsequent versions were re-introduced in 1971, 1977, 1985, 1989, 1996, 1998, 2001, 2005 and in 2008,but none of them passed.CONCLUSION: bill was tarnishing in the drawers of parliament for mare than 4 decades and MP's are saying that WE DON't GAVE THEM TIME TO MAKE A PERFECT LOKPAL BILL}
- Constitution Changer- Corruption in our day to day life is putting our tax into pockets of government and our BRIBE in that of BABUS or officers, all weather lokpal supporter or in opposition to it claim this reality! but some of them do not claim that corruption is not only a threat to out TAX but also to OUR SUPREME LAW i.e CONSTITUTION, and this corruption is corroding CONSTITUTION form its very beginning.CONCLUSION:So if corruption and bribe can spit on constitution's spirit then why a Constitution Changer anti corruption bill cannot be implemented to SAVE CONSTITION FORM MUCH NASTY SPUTUM OF CORRUPTION .However alternative can also be don if we stop giving bribe to save our Constitution and fundamental rights from corruption's rusting effect
- Media's ROLE- Politicians are blaming that it was only media's coverage that popularized this ANDOLAN. Well they are wrong and their tone is of a dictator who controls media. They are wrong because it was not news that powered andolan but it was people's interest flood in society and on social networking sites that forced media to give the required coverage.CONCLUSION: Media of a democracy is free to show what it wants, moreover it shows those things about which people are crazy means media may not have given coverage to the andolan if citizens might not have reacted in that supportive or debative manner.
Weakness of Lokpal- Weak points if intended to exist should not be ignored, instead should be discussed and resolved before bill's implementation.
- Lokpal is intended to be extremely powerful but what if it goes corrupt and use those powers adversely
- Section 23(1) proposes a maximum punishment of life imprisonment for corrupt public servants, while according to Chapter VI titled “Accountability of Officers of Lokpal” the punishment for a Lokpal member found guilty of corruption is just “dismissal, removal or reduction in rank.”
- It appears to violate the division of power between different pillars of the state
- Sec 4(4), which lists out persons not eligible to become chairperson or member of the Lokpal, needs to be modified to exclude any person who is, or has been, a member, sympathiser, associate or supporter of any communal organisation or person.
- (Aruna}Lokpal is not a magic wand, it will take care of an aspect of corruption in governance. It will not take care of complete corruption. It will not really take care of public corruption in different areas
- {Aruna}She felt that the suggestion of dual duties -- curbing corruption and redressing grievances -- under the Jan Lokpal was not feasible
- (Aruna)You will be able to find 11 Lokpal members of integrity, but it is difficult to create a clean set-up of thousands of staffers and hold them accountable,
- Roy said excluding the prime minister and the higher judiciary from lokpal was wrong. "This is a wrong practice. Nobody should be above the law," she said, adding that there should be certain safeguards. "Like both the Lokpal and the Supreme Court should agree on a probe against the prime minister."
- The total estimated revenue of India for 2011-12 as projected in the last budget is Rs7,89,892 crore and 0.25 % of this is nearly 2000 crores, which the Lokpal will have access to without “any administrative or financial sanction from any government agency.” The drafters have to explain why such a huge amount of money is required for an institution, which according to Team Anna is not going to be flooded with thousands of complaints.
- Roy also suggested that the Judicial Standards and Accountability Bill should be revised to facilitate effective action against the higher judiciary while the Central Vigilance Commission (CVC) should be strengthened to probe junior officials.
